Monetary punishment (fine) within the criminal sanctions system

In the Czech Republic, an increase in the use of fines has been observed in the area of sanctions policy since 2016. This reflects efforts to promote fines as an alternative punishment to unconditional sentence of imprisonment in response to the long-standing high prison population. However, there are differences in its application in judicial practice. At the same time, there has been an increase in the number of conversions of this sentence. This research project will focus on the factors that limit the imposition of fines. The research will also examine information about offenders' property and other circumstances prior to sentencing, as well as the use of selected institutes in criminal proceedings and their influence on the imposition and execution of fines. Recidivism among offenders sentenced to fine instead of an unconditional sentence of imprisonment will also be examined. The findings should improve the effectiveness of imposing and enforcing the fine, particularly by reducing the risk of conversion to an unconditional sentence of imprisonment.
